Terms of Use

1. Parties and Scope

These Terms of Use set out the rules for using the hubgenetik.com website operated by Hub Gen Bilişim ve Teknoloji A.Ş. ("Hub Genetik", "we") and the services offered. By using the website or placing an order for a service, you are deemed to have accepted these terms.

2. Description of the Service

Hub Genetik offers a service in which the biological sample (cheek swab) collected from the user is analyzed in a laboratory and the results are turned into a personalized genetic lifestyle guide report. The service consists of the following steps: delivery of the sample collection kit, getting the sample to the laboratory, analysis and reporting.

3. Medical Disclaimer

Hub Genetik reports are intended for information and lifestyle guidance. The results are a probabilistic assessment of predisposition and do not replace a medical diagnosis, treatment, prescription or examination by a physician. A genetic predisposition does not imply certainty; lifestyle and environmental factors (epigenetics) influence whether the results are expressed. Always make decisions about your health together with a physician or specialist.

4. Membership and Account Security

A user who creates an account on the website accepts that the information they provide is accurate and up to date. The user is responsible for the security of their account and the confidentiality of their login details. For tests carried out on behalf of persons under 18, the transaction is completed by their parent/legal guardian, who declares that they have given the necessary consent.

5. Orders, Prices and Payment

Prices stated in the order summary include VAT (KDV). Payments are securely received by credit/debit card through the infrastructure of iyzico, a licensed payment institution; your card details are not stored by Hub Genetik. Order and delivery processes are governed by the "Distance Sales Agreement" and "Delivery & Return Terms" pages; these texts form an integral part of these Terms.

6. Withdrawal and Returns

The right of withdrawal may be exercised within 14 days, before the sample reaches the laboratory and the analysis process begins. Once the sample has been taken into processing, the right of withdrawal ends because the service is performed on a personalized basis. 7. Protection of Personal Data

Genetic data is special category personal data under the KVKK (Turkey's Personal Data Protection Law No. 6698) and is processed only with your explicit consent. Details are provided on the "Privacy & KVKK Privacy Notice" page.

8. Intellectual Property

All content, design, trademarks, logos, report templates and texts on the website belong to Hub Gen Bilişim ve Teknoloji A.Ş. and may not be copied, reproduced or used for commercial purposes without permission. Your personal report and raw data delivered to you, however, belong to you.

9. User Obligations

  • To use the sample collection kit in accordance with the instructions and to provide a sample that belongs only to you (or to a person for whom you are the legal representative),
  • Not to use the website in a manner that is unlawful, misleading or infringes the rights of third parties,
  • To be responsible for the accuracy of the information provided.

10. Limitation of Liability

Hub Genetik does not undertake that the service will be uninterrupted or error-free; it cannot be held responsible for errors arising from sample quality or from the user. If the service cannot be performed for a technical reason, our liability is limited to refunding the amount paid or performing the service again.

11. Right to Make Changes

Hub Genetik reserves the right to update these Terms of Use and the website content without prior notice. The current text takes effect from the moment it is published on the website.

12. Governing Law and Jurisdiction

These Terms are governed by Turkish law. In disputes, the Consumer Arbitration Committees and Consumer Courts have jurisdiction within the monetary limits set by the applicable legislation.
