Distance Sales Agreement

1. Parties

This Distance Sales Agreement (the "Agreement") has been concluded electronically between the SELLER and the BUYER, whose details are set out below, in accordance with the provisions of Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

BUYER

  • The full name/company name, address, phone number and email address provided at the time of the order.

2. Subject of the Agreement

The subject of this Agreement is to set out the rights and obligations of the parties regarding the sale and delivery of the product and/or service that the BUYER has ordered electronically through the SELLER's website hubgenetik.com, the characteristics and sale price of which are stated in the order summary. The BUYER acknowledges that they have read and are informed of the preliminary information concerning the essential characteristics of the product/service, the sale price, the payment method and delivery, and that they have confirmed this electronically.

3. Product / Service Covered by the Agreement

The service covers the laboratory analysis of the biological sample (cheek swab) collected from the BUYER and the provision of the results to the BUYER as a personalized genetic lifestyle guide report. The price of the product/service is stated in the order summary inclusive of VAT (KDV); payment is made by credit/debit card in a single payment (via the iyzico payment infrastructure) or by the other methods offered on the website.

4. General Provisions

  1. The BUYER declares that they have read the essential characteristics, sale price and payment/delivery information of the product covered by the Agreement and have confirmed them electronically.
  2. The service is initiated by means of the sample collection kit delivered to the BUYER. The BUYER is responsible for collecting the sample in accordance with the kit instructions and sending it to the contracted laboratory.
  3. If the service cannot be duly performed, the SELLER informs the BUYER and refunds any amount collected.
  4. The genetic analysis report is intended for information and lifestyle guidance; it does not replace a medical diagnosis, treatment or prescription. The results are a probabilistic assessment of predisposition.

5. Right of Withdrawal

Before performance of the service has begun, the BUYER has the right of withdrawal within 14 (fourteen) days, without giving any reason and without paying any penalty. To withdraw, a written notice sent within this period to info@hubgenetik.com or through the contact channels above is sufficient. Provided that the sample collection kit has not been used and the sample has not been sent to the laboratory, the amount collected is refunded to the original payment method within 14 days of receipt of the withdrawal notice.

6. Cases in Which the Right of Withdrawal Cannot Be Exercised

Pursuant to Article 15 of the Distance Contracts Regulation:

  • The right of withdrawal ends once the sample reaches the laboratory and the analysis process (processing) begins. Because the genetic analysis is prepared specifically on the basis of the BUYER's personal biological data, the service cannot be returned once the sample has been taken into processing.
  • Goods and services of a personalized nature prepared in line with the BUYER's requests or personal needs.
  • Sample collection kits whose packaging has been opened and which are not suitable for return for reasons of hygiene and health.

The BUYER acknowledges and declares that, from the moment they send the sample to the laboratory, they give their explicit consent to the commencement of performance of the service, and that the right of withdrawal will end after this stage.

7. Delivery

Once payment is confirmed, the sample collection kit is shipped to the order address by courier. The analysis begins after the sample reaches the laboratory; the results report is delivered digitally within an estimated 18–21 business days from the date the sample reaches the laboratory.

8. Default

If the BUYER defaults on payments made by credit card, the cardholder is liable under the agreement between them and the issuing bank.

9. Dispute Resolution

Within the monetary limits set each year by the Ministry of Trade, the Consumer Arbitration Committees and Consumer Courts at the BUYER's place of residence have jurisdiction.

10. Entry into Force

Upon the BUYER's electronic confirmation of the order, the BUYER is deemed to have accepted all terms of this Agreement, and the Agreement enters into force.
